Car Dealer sues Pan Jap Motors owner for US$3 Million over alleged unpaid vehicles

Prominent car dealer Mathew Musengezi has filed a lawsuit against businessman Brighton Ushendibaba, director of Pan Jap Motors and sponsor of the Simba Bhora football club.

The lawsuit alleges fraud totaling US$3 million related to vehicle sales and a failed gold venture.

In 2018, Ushendibaba allegedly approached Musengezi with a proposition to sell Musengezi’s high-end vehicles (including Range Rovers, Mercedes GLEs, and Toyota Land Cruisers). Ushendibaba agreed to cover storage fees and pay Musengezi the remaining balance after the sale.

Musengezi claims he never received any payment for the 19 vehicles entrusted to Ushendibaba.

The lawsuit also details a separate joint venture proposal for a gold buying business. Musengezi alleges he provided Ushendibaba with US$221,000 for licenses, permits, and starting capital, but has not been repaid.

The lawsuit further implicates Musengezi’s former lawyer, Tawanda Takaindisa, accusing him of unprofessional conduct and failing to protect Musengezi’s interests for four years.

Musengezi alleges Takaindisa may have colluded with Ushendibaba and altered documents to benefit Ushendibaba. A complaint has been filed against Takaindisa with the Law Society of Zimbabwe.

The lawsuit names businessman Kudakwashe Tagwirei, who allegedly purchased several vehicles from Ushendibaba but never paid. Musengezi claims Ushendibaba uses Tagwirei’s non-payment as an excuse to withhold his money.
