12 disqualified CCC Byo aspiring MPs’ appeal hearing set for Wednesday

THE Supreme Court will hear the appeal of 12 Citizens Coalition for Change (CCC) Bulawayo aspiring Members of Parliament’s who were blocked from contesting in the August 23 polls this Wednesday.

The 12 were removed from the ballot  because their nomination papers were filed late.

Justice Antonio Guvava chaired a three panel bench that scheduled the hearing for Wednesday after holding a case management meeting with the legal teams representing both parties.

The hearing has been set for Wednesday at 12pm.

The 12 were disqualified after an application by a Zanu PF activists who argued that CCC candidates filed nomination papers after the deadline.

Despite Zimbabwe Electoral Commission (ZEC) opposing the activists’ application asserting the 12 filed on time, their disqualification still occurred.

The 12 are: Surrender Kapoikulu (Bulawayo Central), Minenhle Ntandoyenkosi Gumede (Bulawayo North), Nicola Watson (Bulawayo South), Raphael Sibanda (Cowdray Park), Collins Discent Bajila (Emakhandeni/Luveve) and Tshuma Dingilizwe (Entumbane/Njube).

Prince Dube (Entumbane/ Njube), Dereck Gono (Lobengula/Magwegwe), Desmond Makaza (Mpopoma/Mzilikazi), Obert Manduna (Nketa), Desire Moyo (Nkulumane), Soneni Moyo (Pelandaba/Tshabalala), Gift Ostallos Siziba (Pelandaba/Tshabalala), Sichelesile Mahlangu (Pumula) and Albert Mhlanga (Pumula).

In their Supreme Court appeal, the CCC MPs are seeking the court to abstain from jurisdiction over the matter and seek costs at a higher scale, with the legal practitioner and own client expenses to be paid collectively and individually, thereby absolving one from paying the other.
